1. Agreement to Terms

By accessing or using the services provided by Elysian Crest ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

Elysian Crest provides software development, digital transformation, cloud solutions, and related technology services. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time.

3. Use of Services

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit any harmful or malicious code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services
• Use our services to compete with us or for any competitive intelligence gathering

4. Intellectual Property

All content, features, and functionality of our services, including but not limited to text, graphics, logos, and software, are owned by Elysian Crest and are protected by international copyright, trademark, and other intellectual property laws.

5. Client Projects and Deliverables

For client projects:

• Specific terms and conditions will be outlined in separate service agreements
• Ownership of deliverables will be as specified in the applicable service agreement
• We retain the right to use anonymized project information for portfolio and marketing purposes

6. Payment Terms

Payment terms for our services will be specified in individual service agreements. Unless otherwise agreed, invoices are due within the timeframe specified in the agreement. Late payments may incur interest charges.

7. Confidentiality

We understand the importance of confidentiality in business relationships. We will maintain the confidentiality of your proprietary information in accordance with applicable service agreements and applicable law.

8. Warranties and Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• Our services will be uninterrupted or error-free
• Defects will be corrected
• Our services are free of viruses or other harmful components

9. Limitation of Liability

To the maximum extent permitted by law, Elysian Crest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

10. Indemnification

You agree to indemnify, defend, and hold harmless Elysian Crest and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of our services or violation of these Terms.

11. Termination

We may terminate or suspend your access to our services immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use our services will cease immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the new Terms.
